Statute of Limitations is retarded - insane - 08-30-2015 So many people that have committed certain crimes like rape molestation's and shit have gotten off because of the statute of limitations. The law was made because back in the day it was impossible to prove these things after a certain amount of years. A statute of limitation is a law which forbids prosecutors from charging someone with a crime that was committed more than a specified number of years ago. The general purpose of statutes of limitation is to make sure convictions occur only upon evidence (physical or eyewitness) that has not deteriorated with time. With new technology and the fact that a person can confess to a certain crime like Bill Cosby did that shit should go away.I mean period if you committed a crime as horrible as rape and they can prove it, than it shouldn't matter how long ago it happened because you ruined that persons life. RE: Statute of Limitations is retarded - ColtBoy - 08-31-2015 You're missing a few pieces in this, I think. There are two other reasons for applying statues of limitation to criminal laws. First, a plaintiff with a valid claim should pursue it diligently. That is, if a person has been victimized, it really doesn't make sense that they would stay quiet for such a long time. This is obviously not true for murder victims, which is why there is no statue of limitations for murder. Second, for many criminal laws to which these statutes apply, it is said that the indefinite threat of being charged is more cruel than the punishment itself. So if a prosecuting attorney really has a case they can't hang it over the defendant's head for years *and then* prosecute and punish them. I'm not aware of a US state that applies one for rape, but I assume in those states that the terms are sufficiently long for a person to overcome their shame and anxiety. |
